California's Wage Order #9

California's Department of Industrial Relations is responsible for setting workplace rules on a variety of topics, including wages. Wage Order #9 applies to the transportation industry, and mandates a minimum level of break time for meals and rest. While it currently does not apply to public transit drivers governed by a collective bargaining agreement, the Department is currently considering extending its rules to that sector. Such an extension would be disastrous for the state's transit agencies due to a significant increase in cost that would occur if that were to happen. Read more about Wage Order #9 .

Is there language that gives the transit company and the unions an understanding, per Sacrememto, Ca. in using the option of t he 5th hours verse the 6th hour for a lunch break.
